A BILL TO BE ENTITLED
|
|
AN ACT
|
|
Relating to student access of career school and college transcripts |
|
and certificates of completion of training. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 132.062, Education Code, is amended to |
|
read as follows: |
|
Sec. 132.062. WITHHOLDING RECORDS. (a) for the purposes of |
|
this chapter, a student is considered to be in "good standing" if |
|
they have made satisfactory, consistent, and affordable payments |
|
on an outstanding debt obligation for a minimum of six months. |
|
(a-1) Payments toward outstanding debt obligations must be |
|
based on the student's individual income. |
|
(b) A career school or college may not withhold a student's |
|
transcript or certificate of completion of training until if the |
|
student is in good standing with has fulfilled the
|
|
student's
|
|
financial obligation to the school or college. |
|
(c) A career school or college may not charge a student for a |
|
transcript or certificate of completion of training more than the |
|
cost of materials used to print, mail, or electronically send |
|
official transcripts or certificates of completion of training. |

SECTION 2. Section 52.057, Education Code, Subsection |
|
(2)(b) is amended to read as follows: |
|
(b) The person shall pay the applicable amount to the |
|
institution not later than the 30th day after the date the person is |
|
notified of the person's liability for the amount owed. After |
|
receiving the notice and until the amount is paid in full, the |
|
person is not entitled to receive from the institution a |
|
certificate or diploma, if not yet awarded on the date of the |
|
notice, or official
transcript that is
based at
least partially
on
|
|
or includes credit for courses taken while the person was |
|
erroneously classified as a resident of this state. |
|
SECTION 3. This Act takes effect September 1, 2019. |
