A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the dispensing of certain medications by therapeutic |
|
|
optometrists. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter H, Chapter 351, Occupations Code, is |
|
|
amended by adding Section 351.3585 to read as follows: |
|
|
Sec. 351.3585. DISPENSING MEDICATION PERMITTED; FEE |
|
|
AUTHORIZED. A therapeutic optometrist may: |
|
|
(1) without complying with Chapter 558, dispense to a |
|
|
patient of the therapeutic optometrist any medication within the |
|
|
scope of practice of a therapeutic optometrist; and |
|
|
(2) charge a fee for dispensing a medication under |
|
|
this section. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
