A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to exceptions from the requirement for a person under the |
|
|
direction or control of a local entity or campus police department |
|
|
to assist or cooperate with federal immigration officers. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 752.053(c), Government Code, is amended |
|
|
to read as follows: |
|
|
(c) Notwithstanding Subsection (b)(3), a local entity or |
|
|
campus police department may prohibit persons who are employed by |
|
|
or otherwise under the direction or control of the entity or |
|
|
department from assisting or cooperating with a federal immigration |
|
|
officer if the assistance or cooperation occurs: |
|
|
(1) at a place of worship; |
|
|
(2) on the property of a school district, |
|
|
open-enrollment charter school, or private school; |
|
|
(3) at an institution of higher education; or |
|
|
(4) at a hospital, emergency clinic, outpatient |
|
|
clinic, birthing center, ambulatory surgical center, or other |
|
|
facility providing health care services. |

SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
