A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to certain duties of public institutions of higher |
|
education and the Department of State Health Services regarding |
|
policies on the use of epinephrine auto-injectors by public |
|
institutions of higher education. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 51.882, Education Code, is amended by |
|
amending Subsection (d) and adding Subsection (f) to read as |
|
follows: |
|
(d) Each institution of higher education that adopts a |
|
policy under Subsection (a): |
|
(1) must require that the institution's campuses have |
|
personnel or volunteers authorized and trained to administer an |
|
epinephrine auto-injector present; and |
|
(2) shall include the policy in the institution's |
|
student handbook or similar publication and publish the policy on |
|
the institution's Internet website. |
|
(f) An institution of higher education that adopts a policy |
|
under Subsection (a) shall submit to the Department of State Health |
|
Services a copy of the policy and any amendment to the policy |
|
adopted by the institution. The department shall maintain a record |
|
of the most recent policy and amendments submitted by each |
|
institution under this subsection and shall make that information |
|
available to the public on request. |
|
SECTION 2. This Act takes effect September 1, 2019. |
