A BILL TO BE ENTITLED
 
AN ACT
  relating to transcript notation requirements for public
  institutions of higher education.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 51, Education Code, is
  amended by adding Section 51.9364 to read as follows:
         Sec. 51.9364.  DISCIPLINARY NOTATIONS REGARDING SEX
  OFFENSES REQUIRED ON STUDENT TRANSCRIPTS. (a)  In this section:
               (1)  "Institution of higher education" has the meaning
  assigned by Section 61.003.
               (2)  "Sex offense" means a sex offense that an
  institution of higher education is required to report under the
  Jeanne Clery Disclosure of Campus Security Policy and Campus Crime
  Statistics Act (20 U.S.C. Section 1092(f)).
         (b)  If an institution of higher education determines, in
  accordance with the institution's disciplinary procedures, that a
  student has violated the institution's code of conduct by
  committing a sex offense, the institution shall include on the
  student's transcript a disciplinary notation that states:
               (1)  that the student was determined by the institution
  to have violated the institution's code of conduct by committing a
  sex offense; and
               (2)  whether the student was suspended or expelled from
  the institution as a result of the determination.
         (c)  If a student withdraws from an institution of higher
  education pending disciplinary charges alleging that the student
  violated the institution's code of conduct by committing a sex
  offense, the institution shall include on the student's transcript
  a disciplinary notation stating that fact.
         (d)  The Texas Higher Education Coordinating Board shall
  adopt rules as necessary to implement this section, including rules
  establishing a process for a student to appeal for the removal of a
  disciplinary notation under this section.
         SECTION 2.  The Texas Higher Education Coordinating Board
  shall adopt the rules required by Section 51.9364, Education Code,
  as added by this Act, as soon as practicable after this Act takes
  effect.
         SECTION 3.  The change in law made by this Act applies
  beginning with the 2019 fall semester.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2019.
