A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to an objection to the judge assigned in a criminal case. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 74.053(b), Government Code, is amended |
|
to read as follows: |
|
(b) If a party to a civil or criminal case files a timely |
|
objection to the assignment, the judge shall not hear the case. |
|
Except as provided by Subsection (d), each party to the case is only |
|
entitled to one objection under this section for that case. |
|
SECTION 2. The change in law made by this Act applies only |
|
to the right to object to the assignment of a judge assigned under |
|
Chapter 74, Government Code, on or after the effective date of this |
|
Act. An objection to the assignment of a judge assigned under |
|
Chapter 74, Government Code, before the effective date of this Act |
|
is governed by the law in effect on the date of assignment, and the |
|
former law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2019. |
