A BILL TO BE ENTITLED

AN ACT
|
|
|
|

|
relating to availability of certain health benefit plan options for |
|
|
certain participants in the Texas Public School Employees Group |
|
|
Insurance Program. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 1575, Insurance Code, is |
|
|
amended by adding Section 1575.171 to read as follows: |
|
|
Sec. 1575.171. APPLICABILITY OF FORMER LAW. (a) |
|
|
Notwithstanding the change in law made by Chapter 712 (H.B. 3976), |
|
|
Acts of the 85th Legislature, Regular Session, 2017, the trustee |
|
|
shall continue to offer and administer the health benefit plan |
|
|
options offered under this chapter as it existed immediately before |
|
|
September 1, 2017, for participating retirees, dependents, |
|
|
surviving spouses, or surviving dependent children who are enrolled |
|
|
in a health benefit plan offered under the group program in the 2017 |
|
|
plan year, and the former law is continued in effect for that |
|
|
purpose. |

|
(b) The change in law made by Chapter 712 (H.B. 3976), Acts |
|
|
of the 85th Legislature, Regular Session, 2017, applies only to |
|
|
retirees, dependents, surviving spouses, or surviving dependent |
|
|
children who enroll in a health benefit plan offered under the group |
|
|
program beginning with the 2020 plan year or a subsequent plan year. |
|
|
SECTION 2. This Act takes effect September 1, 2019. |
