A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an affirmative defense to the offense of operating a |
|
|
vehicle without displaying two license plates. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 504.943, Transportation Code, is amended |
|
|
by adding Subsection (d-1) to read as follows: |
|
|
(d-1) It is an affirmative defense to prosecution under |
|
|
Subsection (a) for failure to display a license plate at the front |
|
|
of a vehicle that the vehicle: |
|
|
(1) is equipped with driving sensors the functioning |
|
|
of which would be impaired by the display of a front license plate; |
|
|
or |
|
|
(2) was not equipped by the manufacturer with a |
|
|
mounting plate for a front license plate. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an offense committed on or after the effective date of this Act. |
|
|
An offense committed before the effective date of this Act is |
|
|
covered by the law in effect on the date the offense was committed, |
|
|
and the former law is continued in effect for that purpose. For |
|
|
purposes of this section, an offense was committed before the |
|
|
effective date of this Act if any element of the offense occurred |
|
|
before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
