A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to county surety bond requirements for concrete batch |
|
|
plants. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 251, Transportation Code, |
|
|
is amended by adding Section 251.020 to read as follows: |
|
|
Sec. 251.020. SURETY BOND FOR CONCRETE BATCH PLANT DAMAGE |
|
|
TO ROADS. A commissioners court by order may require the owner of a |
|
|
concrete batch plant operating in the county to file a surety bond |
|
|
in an amount determined by the commissioners court and conditioned |
|
|
that the owner will pay to the county an amount to repair any damage |
|
|
to a highway caused by the operation of vehicles used in the |
|
|
operation of the plant. |
|
|
SECTION 2. This Act takes effect September 1, 2019. |
