A BILL TO BE ENTITLED
 
AN ACT
  relating to the hours for the sale or delivery of certain alcoholic
  beverages.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 24.07, Alcoholic Beverage Code, is
  amended to read as follows:
         Sec. 24.07.  WHEN LICENSE ALSO HELD: HOURS OF SALE, ETC. A
  holder of a wine only package store permit who also holds a retail
  dealer's off-premise license for the same location may remain open
  and sell ale, wine, vinous liquors, and beer, for off-premises
  consumption only, on any day and during the same hours that the
  holder of a wine and beer retailer's permit may sell ale, beer, and
  wine, except that the permit holder [he] may not sell wine or vinous
  liquor containing more than 17 percent alcohol by volume [on a
  Sunday or] after 10 p.m. on any day.
         SECTION 2.  Section 105.01, Alcoholic Beverage Code, is
  amended to read as follows:
         Sec. 105.01.  HOURS OF SALE: LIQUOR. [(a)] Except as
  provided in Sections 105.02, 105.03, 105.04, and 105.08, no person
  may sell, offer for sale, or deliver any liquor:
               (1)  on New Year's Day, Thanksgiving Day, or Christmas
  Day;
               (2)  before noon or after 10 p.m. on Sunday; or
               (3)  before 9 [10] a.m. or after 10 [9] p.m. on any
  other day.
         [(b)     When Christmas Day or New Year's Day falls on a Sunday,
  Subsection (a) of this section applies to the following Monday.]
         SECTION 3.  Section 105.02, Alcoholic Beverage Code, is
  amended to read as follows:
         Sec. 105.02.  HOURS OF SALE:  WHOLESALERS AND LOCAL
  DISTRIBUTORS TO RETAILERS. (a) A holder of a wholesaler's permit
  may sell, offer for sale, or deliver liquor to a retailer anytime
  except [Sunday and] Christmas Day.
         (b)  A local distributor's permittee may sell, offer for
  sale, or deliver liquor to a retailer between 5 a.m. and 9 p.m. on
  any day except:
               (1)  [Sunday;
               [(2)]  Christmas Day; or
               (2)  [(3)]  a day on which a package store permittee is
  prohibited from selling liquor.
         SECTION 4.  This Act takes effect September 1, 2019.
