A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to access by certain persons to a first responder's |
|
immunization history during a disaster. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 161, Health and Safety |
|
Code, is amended by adding Section 161.00708 to read as follows: |
|
Sec. 161.00708. ACCESS TO FIRST RESPONDER IMMUNIZATION |
|
HISTORY. (a) In this section, "disaster" means a disaster declared |
|
by the president of the United States, the governor of this state, |
|
or the governor of another state. |
|
(b) The executive commissioner by rule shall establish a |
|
process to allow during a disaster direct access to the |
|
immunization registry for verification of a first responder's |
|
immunization history by: |
|
(1) the first responder; and |
|
(2) during the preparation for or response to the |
|
disaster and with the first responder's electronic or written |
|
consent: |
|
(A) the first responder's employer; or |
|
(B) a person other than the first responder's |
|
employer who is acting as the first responder's supervisor for the |
|
disaster. |

SECTION 2. Not later than January 1, 2020, the executive |
|
commissioner of the Health and Human Services Commission shall |
|
adopt rules to implement Section 161.00708, Health and Safety Code, |
|
as added by this Act. |
|
SECTION 3. This Act takes effect September 1, 2019. |
