A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to termination by a managed care organization of a |
|
provider's participation in Medicaid and child health plan program |
|
provider networks. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 533.006, Government Code, is amended by |
|
adding Subsection (c) to read as follows: |
|
(c) A managed care organization may not terminate a health |
|
care provider's participation in the organization's provider |
|
network without cause. |
|
SECTION 2. Section 62.155, Health and Safety Code, is |
|
amended by adding Subsection (e) to read as follows: |
|
(e) A managed care organization or other entity selected as |
|
a health plan provider under the child health plan program may not |
|
terminate a health care provider's participation in the |
|
organization's or entity's provider network without cause. |
|
SECTION 3. The changes in law made by this Act apply to a |
|
contract between a managed care organization or other entity and a |
|
health care provider entered into or renewed on or after the |
|
effective date of this Act. A contract entered into or renewed |
|
before that date is governed by the law in effect on the date the |
|
contract was entered into or renewed, and that law is continued in |
|
effect for that purpose. |
|
SECTION 4. If before implementing any provision of this Act |
|
a state agency determines that a waiver or authorization from a |
|
federal agency is necessary for implementation of that provision, |
|
the agency affected by the provision shall request the waiver or |
|
authorization and may delay implementing that provision until the |
|
waiver or authorization is granted. |
|
SECTION 5. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2019. |
