A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a notice requirement regarding possible acts of school |
|
violence. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 2, Code of Criminal Procedure, is |
|
amended by adding Article 2.296 to read as follows: |
|
Art. 2.296. NOTICE REGARDING POSSIBLE SCHOOL VIOLENCE. (a) |
|
In this article, "school violence" means any offense: |
|
(1) involving violence that may result in death or |
|
serious bodily injury to any person; and |
|
(2) that occurs at a primary or secondary school. |
|
(b) A law enforcement officer who receives a report or finds |
|
evidence that suggests a person may be contemplating committing an |
|
act of school violence at a public school in this state shall, as |
|
soon as practicable, deliver written notice of the threat to the |
|
superintendent of the affected school or a person designated by the |
|
superintendent. |
|
(c) The superintendent or person designated by the |
|
superintendent shall, on receiving notice under this article, |
|
notify appropriate instructional and support personnel. All |
|
personnel shall keep the information received under this article |
|
confidential. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2019. |
