A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a political subdivision's adoption of zoning |
|
|
regulations for certain coin-operated machines. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2153.452, Occupations Code, is amended |
|
|
to read as follows: |
|
|
Sec. 2153.452. ZONING. A [(a) For purposes of zoning, a] |
|
|
political subdivision of this state may adopt zoning regulations to |
|
|
govern [shall treat] the exhibition of a music or skill or pleasure |
|
|
coin-operated machine [in the same manner as the political
|
|
|
subdivision treats the principal use of the property where the
|
|
|
machine is exhibited]. |
|
|
[(b)
Subsection (a) does not prohibit a municipality from
|
|
|
restricting the exhibition of a coin-operated amusement machine
|
|
|
within 300 feet of a church, school, or hospital.] |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
