A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to driving safety courses provided by certain |
|
organizations. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1001.002, Education Code, is amended by |
|
adding Subsections (a-1) and (a-2) to read as follows: |
|
(a-1) Except as provided by Subsection (a-2), an |
|
organization is exempt from this chapter and any fee imposed under |
|
this chapter if the organization: |
|
(1) is exempt from federal taxation under Section |
|
501(a), Internal Revenue Code of 1986, as an organization described |
|
by Section 501(c)(3) of that code; and |
|
(2) provides to individuals who are at least 50 years |
|
of age a driving safety course that may be used for purposes of |
|
Article 45.0511, Code of Criminal Procedure. |
|
(a-2) Sections 1001.0561, 1001.351(b), 1001.451, and |
|
1001.555 apply to an organization described by Subsection (a-1). |
|
SECTION 2. Subchapter B, Chapter 1001, Education Code, is |
|
amended by adding Section 1001.0561 to read as follows: |
|
Sec. 1001.0561. UNIFORM CERTIFICATES OF COURSE COMPLETION |
|
ISSUED BY CERTAIN EXEMPT ORGANIZATIONS. For an organization exempt |
|
from this chapter under Section 1001.002(a-1): |
|
(1) the department shall provide the organization with |
|
course completion certificate numbers to enable the organization to |
|
issue original and duplicate department-approved uniform |
|
certificates of course completion in a manner that, to the greatest |
|
extent possible, prevents the unauthorized production or the misuse |
|
of the certificates; and |
|
(2) the organization may purchase original or |
|
duplicate certificate numbers for only one approved driving safety |
|
course. |
|
SECTION 3. This Act takes effect September 1, 2019. |
