A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to powdered alcohol. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1.04(4), Alcoholic Beverage Code, is |
|
amended to read as follows: |
|
(4) "Illicit beverage" means: |
|
(A) an alcoholic beverage: |
|
(i) [(A)] manufactured, distributed, |
|
bought, sold, bottled, rectified, blended, treated, fortified, |
|
mixed, processed, warehoused, stored, possessed, imported, or |
|
transported in violation of this code; |
|
(ii) [(B)] on which a tax imposed by the |
|
laws of this state has not been paid and to which the tax stamp, if |
|
required, has not been affixed; or |
|
(iii) [(C)] possessed, kept, stored, owned, |
|
or imported with intent to manufacture, sell, distribute, bottle, |
|
rectify, blend, treat, fortify, mix, process, warehouse, store, or |
|
transport in violation of this code; or |
|
(B) powdered alcohol. |
|
SECTION 2. Section 101.65, Alcoholic Beverage Code, is |
|
amended to read as follows: |
|
Sec. 101.65. BEVERAGES MADE FROM CERTAIN MATERIALS |
|
PROHIBITED. No person may manufacture, import, sell, serve, or |
|
possess for the purpose of sale an alcoholic beverage made from: |
|
(1) any compound made from synthetic materials; |
|
(2) substandard wines; |
|
(3) imitation wines; [or] |
|
(4) must concentrated at any time to more than 80 |
|
degrees Balling; or |
|
(5) powdered alcohol, whether alone or reconstituted. |
|
SECTION 3. This Act takes effect September 1, 2019. |
