A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the facilitation of a funeral procession by a vehicle |
|
|
escort service. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 546, Transportation Code, is amended by |
|
|
adding Subchapter D to read as follows: |
|
|
SUBCHAPTER D. FUNERAL ESCORT SERVICE VEHICLES |
|
|
Sec. 546.101. DEFINITION. In this subchapter, "funeral |
|
|
escort service" means a business that facilitates the movement of |
|
|
traffic for a funeral procession. |
|
|
Sec. 546.102. LIMITATION ON LOCAL AUTHORITIES. A local |
|
|
authority may not prohibit a funeral escort service from |
|
|
facilitating the movement of traffic for a funeral procession. |
|
|
Sec. 546.103. OPERATION OF FUNERAL ESCORT SERVICE VEHICLES. |
|
|
An operator of a vehicle facilitating the movement of a funeral |
|
|
procession for a funeral escort service may proceed past a red or |
|
|
stop signal or stop sign, after slowing as necessary for safe |
|
|
operation. |
|
|
Sec. 546.104. DUTY OF CARE. This subchapter does not |
|
|
relieve the operator of a funeral escort service vehicle from: |
|
|
(1) the duty to operate the vehicle with appropriate |
|
|
regard for the safety of all persons; or |
|
|
(2) the consequences of reckless disregard for the |
|
|
safety of others. |

|
SECTION 2. This Act takes effect September 1, 2019. |
