A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to credit toward a defendant's sentence for time confined |
|
|
in jail or prison before sentencing. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 42.03, Code of Criminal Procedure, is |
|
|
amended by adding Section 2-a to read as follows: |
|
|
Sec. 2-a. In addition to the credit given to a defendant |
|
|
under Section 2, the judge of the court in which the defendant is |
|
|
convicted may give the defendant credit on the defendant's sentence |
|
|
for any time the defendant was confined in jail or prison for |
|
|
another case only, if that confinement occurred after the |
|
|
commission of the offense for which the defendant is convicted and |
|
|
before the date of the defendant's sentencing. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
defendant who is sentenced for an offense on or after the effective |
|
|
date of this Act, regardless of whether the offense is committed |
|
|
before, on, or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
