A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the location of hearings relating to contested cases |
|
|
before the Texas Commission on Environmental Quality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2003.047, Government Code, is amended by |
|
|
adding Subsection (d-1) to read as follows: |
|
|
(d-1) A contested case hearing under this section shall be |
|
|
conducted in the house district in which the facility or proposed |
|
|
facility for which the permit or permit amendment under |
|
|
consideration in the contested case hearing is located. |
|
|
SECTION 2. The change in law made by this Act does not apply |
|
|
to a contested case hearing conducted by the State Office of |
|
|
Administrative Hearings under Section 2003.047, Government Code, |
|
|
as amended by this Act, for which the location of the hearing was |
|
|
determined before the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
