A BILL TO BE ENTITLED
|
|
|
AN ACT
|
| |
|
|
relating to use of funds collected by the Parks and Wildlife |
|
|
Commission from the sale of certain materials. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 86.017, Parks and Wildlife Code, is |
|
|
amended to read as follows: |
|
|
Sec. 86.017. USE OF FUNDS. (a) Except as provided by |
|
|
Subsection (b), funds [Funds] collected by the commission from the |
|
|
sale of marl, sand, gravel, shell, and mudshell may be used for: |
|
|
(1) the enforcement of the provisions of this chapter; |
|
|
(2) [,] the payment of refunds; |
|
|
(3) [, and] the construction and maintenance of fish |
|
|
hatcheries; and |
|
|
(4) the enhancement, preservation, and restoration of |
|
|
fish habitats in rivers and streams. |
|
|
(b) No less than three-fourths of the proceeds from the sale |
|
|
of marl, sand, gravel, shell, and mudshell, after the payment of |
|
|
refunds, shall be used for: |
|
|
(1) the construction and maintenance of fish |
|
|
hatcheries; and |
|
|
(2) the enhancement, preservation, and restoration of |
|
|
fish habitats in rivers and streams. |
|
|
SECTION 2. This Act takes effect September 1, 2019. |
