A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to influenza information for residents of assisted living |
|
|
facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 247.026, Health and Safety Code, is |
|
|
amended by adding Subsections (j) and (k) to read as follows: |
|
|
(j) The executive commissioner shall require each assisted |
|
|
living facility to provide educational information regarding |
|
|
influenza to each resident of the facility not later than September |
|
|
1 of each year. The educational information must include: |
|
|
(1) the risks associated with influenza; |
|
|
(2) the latest influenza vaccination recommendations |
|
|
of the Advisory Committee on Immunization Practices of the federal |
|
|
Centers for Disease Control and Prevention; |
|
|
(3) the availability, effectiveness, and known |
|
|
contraindications of the influenza vaccine; |
|
|
(4) the causes and symptoms of influenza; and |
|
|
(5) the means by which influenza is spread. |
|
|
(k) The executive commissioner may not require an assisted |
|
|
living facility to provide or pay for an influenza vaccination. |
|
|
SECTION 2. This Act takes effect September 1, 2019. |
