A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to recording of oral depositions. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 20, Civil Practice and Remedies Code, is |
|
amended by adding Section 20.003 to read as follows: |
|
Sec. 20.003. NON-STENOGRAPHIC RECORDING. Notwithstanding |
|
Section 20.001, any party may record an oral deposition by a method, |
|
including videotape recording, other than stenographic recording |
|
in accordance with the Texas Rules of Civil Procedure. |
|
SECTION 2. Section 154.101(f), Government Code, is amended |
|
to read as follows: |
|
(f) Except as provided by Section 154.112 and by Chapter 20 |
|
[Section 20.001], Civil Practice and Remedies Code, all depositions |
|
conducted in this state must be recorded by a certified shorthand |
|
reporter. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2019. |
