A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the consideration for public school accountability |
|
|
purposes of certain students receiving residential services in |
|
|
state hospitals. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 39, Education Code, is |
|
|
amended by adding Section 39.0552 to read as follows: |
|
|
Sec. 39.0552. CERTAIN STUDENTS RECEIVING RESIDENTIAL |
|
|
SERVICES IN STATE HOSPITALS NOT CONSIDERED FOR ACCOUNTABILITY |
|
|
PURPOSES. Notwithstanding any other provision of this code, in |
|
|
determining the performance of a school district or campus under |
|
|
this chapter, a student receiving residential services in a state |
|
|
hospital is not considered a student of the school district or |
|
|
campus in which the state hospital is physically located. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
