        |  | A BILL TO BE ENTITLED | 
      
        |  | AN ACT | 
      
        |  | relating to consideration by the board of trustees of a school | 
      
        |  | district of parental complaints regarding student or parent | 
      
        |  | participation in an extracurricular activity. | 
      
        |  | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | 
      
        |  | SECTION 1.  Section 26.011(b), Education Code, is amended to | 
      
        |  | read as follows: | 
      
        |  | (b)  The board of trustees of a school district is not | 
      
        |  | required by Subsection (a) or Section 11.1511(b)(13) to address a | 
      
        |  | complaint that the board receives concerning, relating to, or | 
      
        |  | arising from a student's or parent's participation in an | 
      
        |  | extracurricular activity that does not involve a violation of a | 
      
        |  | right guaranteed by this chapter. This subsection does not affect a | 
      
        |  | claim brought by a parent under the Individuals with Disabilities | 
      
        |  | Education Act (20 U.S.C. Section 1400 et seq.) or a successor | 
      
        |  | federal statute addressing special education services for a child | 
      
        |  | with a disability. | 
      
        |  | SECTION 2.  This Act applies beginning with the 2019-2020 | 
      
        |  | school year. | 
      
        |  | SECTION 3.  This Act takes effect immediately if it receives | 
      
        |  | a vote of two-thirds of all the members elected to each house, as | 
      
        |  | provided by Section 39, Article III, Texas Constitution.  If this | 
      
        |  | Act does not receive the vote necessary for immediate effect, this | 
      
        |  | Act takes effect September 1, 2019. |
