A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the acquisition of real property by the Texas |
|
|
Department of Transportation to protect a state highway. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 203.052, Transportation Code, is amended |
|
|
by adding Subsection (b-1) to read as follows: |
|
|
(b-1) For the purposes of Subsection (b), an interest in |
|
|
real property necessary or convenient to protect a state highway |
|
|
includes an interest in real property adjacent to the right-of-way |
|
|
of the highway on which a building: |
|
|
(1) is maintained in a manner that is structurally |
|
|
unsafe or constitutes a hazard to safety, health, or public welfare |
|
|
because of inadequate maintenance, unsanitary conditions, |
|
|
dilapidation, obsolescence, disaster, damage, or abandonment; and |
|
|
(2) obstructs or partially obstructs the highway. |
|
|
SECTION 2. This Act takes effect September 1, 2019. |
