A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to proof of United States citizenship for the issuance or |
|
|
renewal of a personal automobile insurance policy. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 1951, Insurance Code, is amended by |
|
|
adding Section 1951.005 to read as follows: |
|
|
Sec. 1951.005. PROOF OF CITIZENSHIP REQUIRED. An agent or |
|
|
insurer, including a county mutual insurance company, may not |
|
|
deliver, issue for delivery, or renew in this state a personal |
|
|
automobile insurance policy unless the proposed insured provides to |
|
|
the agent or insurer one of the following documents as proof of |
|
|
United States citizenship: |
|
|
(1) an unexpired passport issued to the person; |
|
|
(2) a certified copy of a birth certificate or other |
|
|
document confirming the person's birth that is admissible in a |
|
|
court of law and establishes the person's identity; or |
|
|
(3) United States citizenship papers issued to the |
|
|
person. |

|
SECTION 2. The change in law made by this Act applies only |
|
|
to a personal automobile insurance policy that is delivered, issued |
|
|
for delivery, or renewed on or after January 1, 2020. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
