A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of certain tier 1 general-law |
|
municipalities to annex certain areas on petition by the area's |
|
property owners. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 43, Local Government Code, |
|
is amended by adding Section 43.0325 to read as follows: |
|
Sec. 43.0325. AUTHORITY OF CERTAIN MUNICIPALITIES TO ANNEX |
|
NONCONTIGUOUS AREA ON OWNER PETITION. (a) This section applies |
|
only to a municipality with a population of 1,780 to 1,800. |
|
(b) A municipality may annex an area that is noncontiguous |
|
to the boundaries of the municipality if: |
|
(1) the area's land development standards are more |
|
stringent than the land development standards in the municipality; |
|
and |
|
(2) the municipality receives a petition requesting |
|
the annexation that: |
|
(A) describes the area by metes and bounds; |
|
(B) is signed by each owner of real property in |
|
the area; and |
|
(C) is filed with the secretary of the |
|
municipality. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2019. |
