A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the duty of a county to refund an amount of $5 or less |
|
|
paid to the county clerk. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 130, Local Government |
|
|
Code, is amended by adding Section 130.911 to read as follows: |
|
|
Sec. 130.911. COUNTY REFUND OF SMALL AMOUNT. A county is |
|
|
not required to refund an amount overpaid or otherwise paid in error |
|
|
to the county clerk by a person if: |
|
|
(1) that amount is $5 or less; |
|
|
(2) the county clerk notifies the person by mail of the |
|
|
amount overpaid or paid in error and includes with the notice a form |
|
|
for requesting a refund; and |
|
|
(3) the person fails to request a refund before the |
|
|
90th day after the date the clerk mailed the notice. |
|
|
SECTION 2. This Act takes effect September 1, 2019. |
