A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of a governmental unit that has withdrawn |
|
|
from a regional planning commission to join another regional |
|
|
planning commission. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 391, Local Government Code, is amended |
|
|
by adding Section 391.016 to read as follows: |
|
|
Sec. 391.016. JOINING COMMISSION AFTER WITHDRAWAL. A |
|
|
governmental unit that has withdrawn from a commission under |
|
|
Section 391.015 may join another commission that is adjacent to the |
|
|
unit if: |
|
|
(1) the transfer is approved by the governing bodies |
|
|
of: |
|
|
(A) the unit; and |
|
|
(B) the commission the unit wishes to join; |
|
|
(2) the governmental unit submits a written request |
|
|
for approval of the transfer to the governor that: |
|
|
(A) is in the form and manner prescribed by the |
|
|
office of the governor; and |
|
|
(B) demonstrates the transfer furthers the |
|
|
purpose of this chapter as described by Section 391.001; and |
|
|
(3) the governor approves the transfer. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
