A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the provision of solid waste disposal services in the |
|
extraterritorial jurisdiction of certain municipalities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 364, Health and Safety |
|
Code, is amended by adding Section 364.0341 to read as follows: |
|
Sec. 364.0341. SOLID WASTE DISPOSAL SERVICES IN |
|
EXTRATERRITORIAL JURISDICTION OF CERTAIN MUNICIPALITIES. (a) This |
|
section applies only to a municipality wholly or partly located in a |
|
county with a population of more than 54,000 and less than 54,500. |
|
(b) Notwithstanding Sections 364.011(a) and 364.034(a), a |
|
county may offer, require the use of, and charge a fee for solid |
|
waste disposal services in the extraterritorial jurisdiction of a |
|
municipality. |
|
(c) A municipality may not provide solid waste disposal |
|
services or charge a fee for those services in the municipality's |
|
extraterritorial jurisdiction if the county provides those |
|
services under Subsection (b). |
|
SECTION 2. This Act takes effect September 1, 2019. |
