A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the provision of solid waste disposal services in the
  extraterritorial jurisdiction of certain municipalities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 364, Health and Safety
  Code, is amended by adding Section 364.0341 to read as follows:
         Sec. 364.0341.  SOLID WASTE DISPOSAL SERVICES IN
  EXTRATERRITORIAL JURISDICTION OF CERTAIN MUNICIPALITIES. (a) This
  section applies only to a municipality wholly or partly located in a
  county with a population of more than 54,000 and less than 54,500.
         (b)  Notwithstanding Sections 364.011(a) and 364.034(a), a
  county may offer, require the use of, and charge a fee for solid
  waste disposal services in the extraterritorial jurisdiction of a
  municipality.
         (c)  A municipality may not provide solid waste disposal
  services or charge a fee for those services in the municipality's
  extraterritorial jurisdiction if the county provides those
  services under Subsection (b).
         SECTION 2.  This Act takes effect September 1, 2019.
