A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to damage to a motor vehicle caused by the vehicle being |
|
|
flooded. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 501.091, Transportation Code, is amended |
|
|
by adding Subdivision (4-a) to read as follows: |
|
|
(4-a) "Flooded" means, with respect to damage to a |
|
|
motor vehicle, submerged in water that: |
|
|
(A) rises higher than a doorsill of the vehicle, |
|
|
enters the vehicle's passenger, trunk, or engine compartment, and |
|
|
comes into contact with the vehicle's electrical system; or |
|
|
(B) causes an insurance company to pay a claim on |
|
|
and take possession of the vehicle. |
|
|
SECTION 2. Section 501.09112(d), Transportation Code, is |
|
|
amended to read as follows: |
|
|
(d) A salvage vehicle title or a salvage record of title for |
|
|
a vehicle that is a salvage motor vehicle because of damage caused |
|
|
exclusively by the vehicle being flooded [flood] must bear a |
|
|
notation that the department considers appropriate. If the title |
|
|
for a motor vehicle reflects the notation required by this |
|
|
subsection, the owner may sell, transfer, or release the motor |
|
|
vehicle only as provided by this subchapter. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
