A BILL TO BE ENTITLED
 
AN ACT
  relating to damage to a motor vehicle caused by the vehicle being
  flooded.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 501.091, Transportation Code, is amended
  by adding Subdivision (4-a) to read as follows:
               (4-a)  "Flooded" means, with respect to damage to a
  motor vehicle, submerged in water that:
                     (A)  rises higher than a doorsill of the vehicle,
  enters the vehicle's passenger, trunk, or engine compartment, and
  comes into contact with the vehicle's electrical system; or
                     (B)  causes an insurance company to pay a claim on
  and take possession of the vehicle.
         SECTION 2.  Section 501.09112(d), Transportation Code, is
  amended to read as follows:
         (d)  A salvage vehicle title or a salvage record of title for
  a vehicle that is a salvage motor vehicle because of damage caused
  exclusively by the vehicle being flooded [flood] must bear a
  notation that the department considers appropriate. If the title
  for a motor vehicle reflects the notation required by this
  subsection, the owner may sell, transfer, or release the motor
  vehicle only as provided by this subchapter.
         SECTION 3.  This Act takes effect September 1, 2019.
