A BILL TO BE ENTITLED
 
AN ACT
  relating to the return-to-play protocol for students removed from
  interscholastic athletic activity on the basis of a suspected
  concussion.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 38.157, Education Code, is amended by
  adding Subsections (d)
  and (e) to read as follows:
         (d)  Notwithstanding any other provision of this section, a
  treating physician may delegate to an advanced practice registered
  nurse or physician assistant, acting under the physician's
  supervision:
               (1)  the evaluation of a student to be performed under
  Subsection (a)(1) using established medical protocols based on
  peer-reviewed scientific evidence; and
               (2)  the completion of the written statement required
  under Subsection (a)(3) indicating that, in the evaluating
  professional's judgment, it is safe for the student to return to
  play.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2019.
