A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the return-to-play protocol for students removed from |
|
interscholastic athletic activity on the basis of a suspected |
|
concussion. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 38.157, Education Code, is amended by |
|
adding Subsections (d) |
|
and (e) to read as follows: |
|
(d) Notwithstanding any other provision of this section, a |
|
treating physician may delegate to an advanced practice registered |
|
nurse or physician assistant, acting under the physician's |
|
supervision: |
|
(1) the evaluation of a student to be performed under |
|
Subsection (a)(1) using established medical protocols based on |
|
peer-reviewed scientific evidence; and |
|
(2) the completion of the written statement required |
|
under Subsection (a)(3) indicating that, in the evaluating |
|
professional's judgment, it is safe for the student to return to |
|
play. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2019. |
