A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to service of a notice of an application for a protective |
|
|
order. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 82.043(c), Family Code, is amended to |
|
|
read as follows: |
|
|
(c) Notice of an application for a protective order must be |
|
|
served on the person [in the same manner as citation under the Texas
|
|
|
Rules of Civil Procedure, except that service by publication is not
|
|
|
authorized]. |
|
|
SECTION 2. Section 82.043, Family Code, as amended by this |
|
|
Act, applies only to a notice of an application for a protective |
|
|
order served on or after the effective date of this Act. An |
|
|
application for a protective order served before the effective date |
|
|
of this Act is governed by the law in effect immediately before that |
|
|
date, and the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
