A BILL TO BE ENTITLED
 
AN ACT
  relating to the use of certain drugs in breeding stock by or on the
  prescription of a veterinarian.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 801, Occupations Code, is
  amended by adding Section 801.365 to read as follows:
         Sec. 801.365.  BREEDING STOCK. (a)  
  In this section,
  "breeding stock" means an animal intended by its owner or
  caretaker, with the input of the veterinarian, to be used for
  selective mating to maintain or enhance desirable genetic traits in
  future generations and not intended for human or animal
  consumption. Desirable genetic traits may include, but not limited
  to, growth rate and yield of products including eggs, milk, or meat.
         (b)  A veterinarian may administer, prescribe, dispense, or
  deliver any drug for off-label use in breeding stock.
         (c)  An owner or caretaker may use a drug described by
  Subsection (b) in breeding stock in the manner prescribed by a
  veterinarian.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2019.
