A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the revocation of community supervision for a violation |
|
of a condition of community supervision involving the commission of |
|
an offense. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Article 42A.751, Code of Criminal Procedure, is |
|
amended by adding Subsection (h-1) to read as follows: |
|
(h-1) Notwithstanding Subsection (d), the court may not |
|
revoke the community supervision of a defendant for a violation of a |
|
condition of community supervision that involves being arrested for |
|
or charged with an offense unless: |
|
(1) the person is convicted of the offense; or |
|
(2) the offense is an offense under Title 5, Penal |
|
Code, or listed in Article 42A.054(a). |
|
SECTION 2. The change in law made by this Act applies to a |
|
person on community supervision on or after the effective date of |
|
this Act, regardless of whether the person was placed on community |
|
supervision before, on, or after the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2019. |
