A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to distance requirements for premises issued a package |
|
|
store permit. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 22, Alcoholic Beverage Code, is amended |
|
|
by adding Section 22.18 to read as follows: |
|
|
Sec. 22.18. DISTANCE FROM OTHER PACKAGE STORES. Except as |
|
|
provided by Section 109.59, on or after September 1, 2019, the |
|
|
commission may not issue a permit under this chapter for a premises |
|
|
that is located within 5000 feet of the premises of another package |
|
|
store permittee. |
|
|
SECTION 2. Section 109.59(a), Alcoholic Beverage Code, is |
|
|
amended to read as follows: |
|
|
(a) If at the time an original alcoholic beverage permit or |
|
|
license is granted for a premises the premises satisfies the |
|
|
requirements regarding distance from schools, churches, and other |
|
|
types of premises established in this code, including Section |
|
|
22.18, |
|
|
and any other law or ordinance of the state or a political |
|
|
subdivision of the state in effect at that time, the premises shall |
|
|
be deemed to satisfy the distance requirements for all subsequent |
|
|
renewals of the license or permit. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
