A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to qualifications for responding to contract |
|
|
solicitations from the Texas Department of Transportation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 201, Transportation Code, |
|
|
is amended by adding Section 201.212 to read as follows: |
|
|
Sec. 201.212. QUALIFICATIONS FOR RESPONDING TO CONTRACT |
|
|
SOLICITATION. The department may not set qualifications for |
|
|
responding to a request for proposals or other contract |
|
|
solicitation that prohibits a person from responding to the |
|
|
solicitation on the basis of having a certain minimum number of |
|
|
years of experience in providing services to a local, state, or |
|
|
federal entity. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a contract for which the Texas Department of Transportation |
|
|
first advertises or otherwise solicits bids, proposals, offers, or |
|
|
qualifications on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
