A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the licensing of and requirements for certain |
|
child-care facilities that detain certain children. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 42, Human Resources Code, |
|
is amended by adding Section 42.0415 to read as follows: |
|
Sec. 42.0415. STANDARD LICENSE REQUIREMENTS; WAIVER |
|
PROHIBITED. (a) The commission shall issue or renew a license of a |
|
child-care facility that is operated by or under a contract with |
|
United States Immigration and Customs Enforcement to enforce |
|
federal immigration laws and that detains children, in the same |
|
manner and subject to the same requirements as the commission |
|
issues or renews a license for any other child-care facility under |
|
this chapter. |
|
(b) The commission may not waive any licensing requirement, |
|
including minimum standards, for a child-care facility described by |
|
Subsection (a). |
|
SECTION 2. Section 42.0415, Human Resources Code, as added |
|
by this Act, applies only to a license issued or renewed on or after |
|
the effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2019. |
