A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the election of trustees of certain school districts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 11.052, Education Code, is amended by |
|
|
adding Subsection (b-3) and amending Subsection (d) to read as |
|
|
follows: |
|
|
(b-3) Subsection (c) does not apply in the case of an order |
|
|
adopted under this subsection. The board of trustees of an |
|
|
independent school district located wholly or partly in a county |
|
|
with a population of more than two million but less than three |
|
|
million shall order that trustees of the district are to be elected |
|
|
from single-member trustee districts if the district, in October |
|
|
2017, had: |
|
|
(1) a student enrollment of more than 50,000; |
|
|
(2) a student enrollment of more than 35,000 but less |
|
|
than 40,000; or |
|
|
(3) a student enrollment of more than 24,000 but less |
|
|
than 28,000. |
|
|
(d) An order of the board adopted under Subsection (a), [or] |
|
|
(b), or (b-3) must be entered not later than the 120th day before |
|
|
the date of the first election at which all or some of the trustees |
|
|
are elected from single-member trustee districts authorized by the |
|
|
order. |
|
|
SECTION 2. The board of trustees of a school district to |
|
|
which Section 11.052(b-3), Education Code, as added by this Act, |
|
|
applies shall adopt an order as required by that section not later |
|
|
than December 31, 2019. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
