A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to billing requirements for certain health care |
|
|
facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 324, Health and Safety |
|
|
Code, is amended by adding Section 324.1015 to read as follows: |
|
|
Sec. 324.1015. BILLING STATEMENT; CIVIL LIABILITY. (a) A |
|
|
facility's billing statement to a consumer must include: |
|
|
(1) an itemized list of each health care service |
|
|
provided to the consumer; |
|
|
(2) an itemized list of each health care supply |
|
|
provided to the consumer; and |
|
|
(3) a list of each physician or other health care |
|
|
practitioner licensed to provide health care in this state who |
|
|
provided a health care service to the consumer. |
|
|
(b) A consumer is not liable to a facility for any billed |
|
|
charge on a billing statement that violates this section. If a |
|
|
facility files a civil action against a consumer for a charge |
|
|
described by this subsection and the consumer prevails in the |
|
|
action, the consumer may recover reasonable attorney's fees and |
|
|
costs. |
|
|
SECTION 2. Section 324.1015, Health and Safety Code, as |
|
|
added by this Act, applies only to a health care service provided on |
|
|
or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
