A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to the standing of municipalities in certain civil |
|
|
actions. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

|
SECTION 1. Chapter 30, Civil Practice and Remedies Code, is |
|
|
amended by adding Section 30.022 to read as follows: |
|
|
Sec. 30.022. STANDING OF MUNICIPALITIES IN CERTAIN ACTIONS. |
|
|
A municipality has standing to bring or intervene in a civil action |
|
|
if the intervention is necessary to protect or defend the rights of |
|
|
a resident of the municipality. This section applies regardless of |
|
|
whether the party opposing the municipal resident is located |
|
|
outside of the municipality. |
|
|
SECTION 2. Section 30.022, Civil Practice and Remedies |
|
|
Code, as added by this Act, applies only to an action filed on or |
|
|
after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
