A BILL TO BE ENTITLED
|
|
AN ACT
|
|
Relating to political advertising. |
|
|
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 251.001(16), Elections Code, is amended |
|
to read as follows: |
|
(16) "Political advertising" means a communication |
|
supporting or opposing a candidate for nomination or election to a |
|
public office or office of a political party, a political party, a |
|
public officer, or a measure, including a communication that |
|
references the position of a candidate or officeholder on a measure |
|
if the communication is made with a principal intent of positively |
|
or negatively influencing the public's perception of the candidate |
|
or officeholder, that: |
|
(A) in return for consideration, is published in |
|
a newspaper, magazine, or other periodical or is broadcast by radio |
|
or television; or |
|
(B) appears: |
|
(i) in a pamphlet, circular, flier, |
|
billboard or other sign, bumper sticker, or similar form of written |
|
communication; or |
|
(ii) on an Internet website. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2019. |
