A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the application for and expiration of a license to carry |
|
a handgun. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Sections 411.1741(a) and (b), Government Code, |
|
are amended to read as follows: |
|
(a) When a person applies for an original or renewal license |
|
to carry a [concealed] handgun under this subchapter, the person |
|
may make a voluntary contribution in any amount to the fund for |
|
veterans' assistance established by Section 434.017. |
|
(b) The department shall: |
|
(1) include space on the first page of each |
|
application for an original or renewal license to carry a |
|
[concealed] handgun that allows a person applying for an original |
|
or renewal license to carry a [concealed] handgun to indicate the |
|
amount that the person is voluntarily contributing to the fund; and |
|
(2) provide an opportunity for the person to |
|
contribute to the fund during the application process for an |
|
original or renewal license to carry a [concealed] handgun on the |
|
department's Internet website. |
|
SECTION 2. The heading to Section 411.181, Government Code, |
|
is amended to read as follows: |
|
Sec. 411.181. NOTICE OF CHANGE OF INFORMATION; DUPLICATE |
|
LICENSE [ADDRESS OR NAME]. |
|
SECTION 3. Section 411.181, Government Code, is amended by |
|
adding Subsection (a-1) to read as follows: |
|
(a-1) If a license holder whose license will expire under |
|
Section 411.183(a)(1)(B) or (b)(1)(B) is granted an extension for |
|
the license holder's lawful presence in the United States as |
|
determined by the United States agency responsible for citizenship |
|
and immigration in compliance with federal law, the license holder |
|
may apply to the department for a duplicate license with an updated |
|
expiration date by providing to the department the person's license |
|
number and evidence of the extension. The duplicate license must |
|
provide for an expiration date, calculated in accordance with |
|
Section 411.183(a) or (b), as applicable, that takes into account |
|
the extension of the period for which the license holder may be |
|
lawfully present in the United States. |
|
SECTION 4. Sections 411.183(a), (b), and (c), Government |
|
Code, are amended to read as follows: |
|
(a) A license issued under this subchapter expires on: |
|
(1) the earlier of: |
|
(A) the first birthday of the license holder |
|
occurring after the fourth anniversary of the date of issuance; or |
|
(B) the expiration of the license holder's lawful |
|
presence in the United States as determined by the United States |
|
agency responsible for citizenship and immigration in compliance |
|
with federal law; or |
|
(2) the first anniversary of the date of issuance, if |
|
there is no definite expiration date for the applicant's lawful |
|
presence in the United States. |
|
(b) A renewed license expires on: |
|
(1) the earlier of: |
|
(A) the license holder's birthdate, five years |
|
after the date of the expiration of the previous license; or |
|
(B) the expiration of the license holder's lawful |
|
presence in the United States as determined by the United States |
|
agency responsible for citizenship and immigration in compliance |
|
with federal law; or |
|
(2) the first anniversary of the date of renewal, if |
|
there is no definite expiration date for the applicant's lawful |
|
presence in the United States. |
|
(c) Except as otherwise provided by Section 411.181(a-1), a |
|
[A] duplicate license expires on the date the license that was |
|
duplicated would have expired. |
|
SECTION 5. The changes in law made by this Act apply only to |
|
an application for an original, renewal, or duplicate license to |
|
carry a handgun submitted on or after the effective date of this |
|
Act. An application submitted before the effective date of this Act |
|
is governed by the law in effect on the date the application was |
|
submitted, and the former law is continued in effect for that |
|
purpose. |
|
SECTION 6. This Act takes effect September 1, 2019. |
