A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the act of inciting suicide; creating a criminal |
|
|
offense. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Sec. 22.08, Penal Code, is amended to read as |
|
|
follows: |
|
|
(a) A person commits an offense if, with intent to promote |
|
|
or assist the commission of suicide by another, he incites, aids, or |
|
|
attempts to aid the other to commit or attempt to commit suicide. |
|
|
|
|
|
(b) An offense under this section is a Class C misdemeanor |
|
|
unless the actor's conduct causes suicide or attempted suicide that |
|
|
results in serious bodily injury, in which event the offense is a |
|
|
state jail felony. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
