A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to mailed notice of certain environmental permits. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 5.552, Water Code, is amended by adding |
|
Subsection (d-1) to read as follows: |
|
(d-1) For any notice required by mail for a permit or permit |
|
amendment issued under Subchapter C, Chapter 361, Health and Safety |
|
Code, or Subchapter C, Chapter 382, Health and Safety Code, if the |
|
elementary or middle school nearest to the facility or proposed |
|
facility provides a bilingual education program as required by |
|
Subchapter B, Chapter 29, Education Code, the notice must be |
|
written in English and in the language taught in the bilingual |
|
education program. |
|
SECTION 2. Section 5.553, Water Code, is amended by adding |
|
Subsection (d-1) to read as follows: |
|
(d-1) For any notice required by mail for a permit or permit |
|
amendment issued under Subchapter C, Chapter 361, Health and Safety |
|
Code, or Subchapter C, Chapter 382, Health and Safety Code, if the |
|

|

SECTION 3. The change in law made by this Act applies only |
|
to a permit application that is filed with the Texas Commission on |
|
Environmental Quality on or after the effective date of this Act. |
|
A |
|
permit application filed before the effective date of this Act is |
|
governed by the law in effect on the date of filing, and that law is |
|
continued in effect for that purpose. |
|
SECTION 4. This Act takes effect September 1, 2019. |
