A BILL TO BE ENTITLED
 
AN ACT
 
  relating to certain distributions to the available school fund.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 43.001(b), Education Code, is amended to
  read as follows:
         (b)  The available school fund, which shall be apportioned
  annually to each county according to its scholastic population,
  consists of:
               (1)  the distributions to the fund from the permanent
  school fund as provided by Sections [Section] 5(a) and (g), Article
  VII, Texas Constitution;
               (2)  one-fourth of all revenue derived from all state
  occupation taxes, exclusive of delinquencies and cost of
  collection;
               (3)  one-fourth of revenue derived from state gasoline
  and special fuels excise taxes as provided by law; and
               (4)  all other appropriations to the available school
  fund made by the legislature for public school purposes.
         SECTION 2.  Section 43.001(d), Education Code, as amended by
  Chapters 581 (S.B. 810) and 705 (H.B. 3526), Acts of the 85th
  Legislature, Regular Session, 2017, is reenacted and amended to
  read as follows:
         (d)  Each biennium the State Board of Education shall set
  aside an amount equal to 50 percent of the distribution for that
  biennium from the permanent school fund to the available school
  fund as provided by Sections [Section] 5(a) and (g), Article VII,
  Texas Constitution, to be placed, subject to the General
  Appropriations Act, in the state instructional materials and
  technology fund established under Section 31.021.
         SECTION 3.  This Act takes effect January 1, 2020, but only
  if the constitutional amendment proposed by the 86th Legislature,
  Regular Session, 2019, providing for increased distributions to the
  available school fund is approved by the voters.  If that proposed
  constitutional amendment is not approved by the voters, this Act
  has no effect.
