A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to certain fees of and costs incurred by sheriffs and |
|
|
constables. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 118.131(h), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(h) If the commissioners court does not set fees under this |
|
|
section, the fees for services by the offices of the sheriff and |
|
|
constables are those fees provided by law in effect for the |
|
|
preceding fiscal year [on August 31, 1981]. |
|
|
SECTION 2. Section 118.133(d), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(d) Fees collected under this section [Act] shall be |
|
|
deposited in the county treasury to the credit of the general fund |
|
|
of the county. |
|
|
SECTION 3. Section 118.134(b), Local Government Code, is |
|
|
amended to read as follows: |
|
|
(b) Subsection (a) of this section does not apply to costs |
|
|
incurred on property seized in conjunction with an offense alleged |
|
|
under the Penal Code, the Code of Criminal Procedure, or Title 6 or |
|
|
7, Transportation Code [Title 116, Vernon's Texas Civil Statutes], |
|
|
when the owner of the property is subsequently found to be not |
|
|
guilty of an offense or other proscribed activity described in |
|
|
those statutes, or if other charges whether criminal or civil are |
|
|
dropped. |

|
SECTION 4. This Act takes effect September 1, 2019. |
