A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to a suit against The University of Texas at Tyler. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 76.04, Education Code, is amended to |
|
|
read as follows: |
|
|
Sec. 76.04. SUITS[; VENUE; CITATION]. [The board may sue
|
|
|
and be sued in the name of the institution.] Venue for a suit |
|
|
against the institution is in Smith or Travis County. This section |
|
|
may not be construed as granting legislative consent for a suit |
|
|
against the board or the institution except as authorized by law. |
|
|
[The institution may be impleaded by service of citation on its
|
|
|
president, and legislative consent to suits against the institution
|
|
|
is granted.] |
|
|
SECTION 2. Section 76.04, Education Code, as amended by |
|
|
this Act, applies only to a cause of action that accrues on or after |
|
|
the effective date of this Act. A cause of action that accrues |
|
|
before the effective date of this Act is governed by the law |
|
|
applicable to the cause of action immediately before that date, and |
|
|
that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2019. |
