A BILL TO BE ENTITLED
 
AN ACT
  relating to certain plumbing, air conditioning, and electrical
  services performed as a volunteer during a disaster.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Title 8, Occupations Code, is amended by adding
  Chapter 1306 to read as follows:
  CHAPTER 1306. VOLUNTEER SERVICES DURING DISASTER
         Sec. 1306.001.  DEFINITIONS. In this chapter: 
               (1)  "License holder" means a person who holds a
  license, endorsement, registration, or other authorization
  required to engage in an occupation or activity regulated under
  Chapter 1301, 1302, or 1305.
               (2)  "Technical services" means services for which a
  license holder is required to hold a license, endorsement,
  registration, or other authorization issued under Chapter 1301,
  1302, or 1305 to provide the services. 
         Sec. 1306.002.  VOLUNTEER SERVICES DURING DISASTER. (a)  A
  license holder employed by the United States government or licensed
  in another state may perform technical services as a volunteer in
  this state without holding a license issued in this state during a
  disaster: 
               (1)  subject to the state emergency management plan,
  adopted under Section 418.042, Government Code; or
               (2)  declared by the governor or the president of the
  United States. 
         (b)  A supervision requirement under Chapter 1301, 1302, or
  1305 does not apply to technical services performed by a license
  holder as a volunteer during circumstances described by Subsection
  (a).
         (c)  This section does not apply to technical services
  performed by a license holder for compensation or other
  remuneration.
         (d)  The Public Safety Commission shall adopt any rules
  necessary to implement this section.
         SECTION 2.  As soon as practicable after the effective date
  of this Act, the Public Safety Commission shall adopt rules as
  necessary to implement Chapter 1306, Occupations Code, as added by
  this Act.
         SECTION 3.  This Act takes effect September 1, 2019.
