AN ACT
|
|
|
relating to certain contracts requiring competitive bidding by the |
|
|
Texas Department of Transportation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 223.001, Transportation Code, is amended |
|
|
to read as follows: |
|
|
Sec. 223.001. CONTRACT REQUIRING COMPETITIVE BIDS. |
|
|
(a) This section applies only to a highway that is part of the |
|
|
state highway system. |
|
|
(b) The department shall submit for competitive bids each |
|
|
contract for: |
|
|
(1) the improvement of a highway [that is part of the
|
|
|
state highway system]; [or] |
|
|
(2) materials to be used in the construction or |
|
|
maintenance of a [that] highway; or |
|
|
(3) traffic control or safety devices to be used on a |
|
|
highway. |
|
|
SECTION 2. This Act applies only in relation to a contract |
|
|
for which the Texas Department of Transportation first advertises |
|
|
or otherwise solicits bids, proposals, offers, or qualifications on |
|
|
or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2019. |
